Service Agreement

This Service Agreement (the "Agreement") is made between: Pink Flamingo Pool Company, LLC (the "Company"), located at 1652 Katy Lane, Fort Mill, SC 29708 and the undersigned Client (the "Client").

4. Payment Terms

Clients may pay for services, parts, and supplies, with payments processed securely through third-party providers like Skimmer and QuickBooks. By providing payment information, Clients authorize payment transactions.

Billing & Payment Due Dates

• Regular Pool Service: Invoiced one month in advance, due within 15 days.

• One-Time & Additional Services: Payment due on the day of service.

• Service Calls & Repairs: $125 per visit, plus parts and labor, with all charges pre-approved by the Client.

Late Payments & Service Discontinuation

• A $25 late fee applies to balances over 30 days past due.

• Services will be paused if payment is not received within 30 days of the due date.

• Clients will receive reminders before service is discontinued and should contact us for payment arrangements if needed.

• Unresolved balances may result in service agreement cancellation.

5. Credit Card Authorization

Credit Card on File

By signing this agreement, I authorize the Company to keep my credit card on file and charge it for:

• Recurring Billing: Monthly charges if enrolled in autopay, starting on the 1st or within 3 days of receiving an invoice.

• One-Time Payments: For authorized services requested via email, text, or phone.

• Past-Due Balances: If the account remains unpaid after 60 days and two written reminders, the Company may charge the card for the outstanding balance.

Clients are responsible for:

• Payment Failures & Billing Disputes: Settling declined charges within 3 days. Disputes should be addressed with the Company before contacting the bank.

• Credit Card Updates: Informing the Company of any changes to credit card details promptly.

6. Service Policies

Water Levels: Clients must keep water at least halfway up the skimmer. Technicians will not fill pools without written permission.

Accessibility: Clients must provide safe access (unlocked gates, secured pets, clear pathways). If access is restricted, service may be skipped or rescheduled when possible.

Missed Service: Delays due to holidays, weather, or unforeseen events will not be credited unless rescheduling is not attempted.

Pets: Clients must secure pets. The Company is not responsible for injuries or escapes.

Credit Card: Clients must keep a valid credit card on file (see agreement below for details).

Excessive Debris & Storm Cleanup: The first 15 minutes are included; extra labor is $31.25 per 15 minutes.

7. Repairs & Parts Replacement

Clients may choose to pre-authorize minor repairs up to $75 for quicker service. Repairs exceeding this amount will require written or verbal approval before work begins.

The company is not responsible for damages due to pre-existing conditions, equipment failure, or manufacturer defects. For full details, please refer to our Terms of Use.

8. Termination

Timeframe: Either party may terminate this agreement with 30 days’ written notice. All balances must be paid in full. No refunds will be issued for partial months of service if the Client terminates early.

9. Electronic Communication & Text Message Authorization

Invoices: Emailed to the address in this agreement. Client may also opt to receive them by text.

Text Notifications: By opting in, I authorize Pink Flamingo Pool Company, LLC to send invoices, billing reminders, payment updates, and service notifications via text. Standard for billing, payment reminders, and service updates via text. Standard message and data rates may apply. I understand that I can opt out at any time by replying "STOP," and that opting out may impact billing and service updates.

11. Miscellaneous

Entirety of Agreement: This Agreement constitutes the entire agreement between both parties and supersedes all prior discussions or agreements.

Amendments: Any amendments or modifications to this Agreement must be made in writing and signed by both parties.

Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain valid and in full effect.

12. Acknowledgement & Signature

Client Agreement

I, the undersigned, agree to the terms outlined in this Service Agreement, including all service, billing, and cancellation polices. I also authorize Pink Flamingo Pool Company, LLC to charge my credit card on file as outlined in the agreement.

Credit Card Authorization (ONLY complete if credit card holder is different that Client listed above)

If the credit card holder is different from the Client, the cardholder must complete and sign the section below.

I, the undersigned, authorize Pink Flamingo Pool Company, LLC to charge my credit card for services rendered under this agreement. I understand that I am responsible for any authorized charges, including recurring payments, one-time service requests, and past-due balances as outlined in the agreement.
